If
this section of our website can only accomplish one
thing, I want it to be this: that it
helped people charged with a crime in New Jersey
know and understand their Constitutional rights.
Why? Because in my opinion, these rights are the
backbone of what it means to be Americans. These
rights are what countless thousands of brave
American men and women over the past two hundred
plus years have worked, fought and died to preserve.
They are their gifts to you and me. When we invoke
them, we should do so proudly.
Here they are in a nutshell:
1. You have the right to a trial that is both speedy
and public.
2. You have the right to make the State prove each
and every element of each charge against you. If the
State cannot do so, you have the right to have the
charge in question dismissed.
3. You have the right to face and cross-examine each
witness against you.
4. You have the right to present evidence on your
own behalf
5. You have the right to testify on your own behalf,
as well as the right to not testify. If you choose
not to testify, it cannot be used as evidence of
your guilt.
6. You have the right to be free from unreasonable
searches or seizures of your person and your
property.
7. You have the right to have evidence that was
obtained as a result of an improper search or
seizure to not be used against you by the State.
