WHAT TO DO IF YOU ARE
ARRESTED
1. Remember that being arrested has nothing to do
with being guilty.
2. Remember that you don’t have to prove yourself
innocent or “not guilty”. The State has to prove you
guilty, and to do so be proving each and every
element of the offense you are charged with beyond a
reasonable doubt.
3. Do not discuss your case with the police, even if
they are nice, likeable and assure you that it will
help you. It only provides the State with more
evidence to use against you.
4. If you are injured, make sure you promptly seek
medical attention.
5. If property damage or bodily injury is involved,
make sure you notify your insurance company.
6. Resist the urge to discuss your case with family,
friends, co-workers, etc. It usually does you little
good and might do you a lot of harm.
7. Where appropriate, take photographs of the scene
or situation.
8. Keep copies of all papers you are given.
9. Write down the names, addresses and telephone
numbers of all witnesses or potential witnesses.
10. Contact an experienced New Jersey criminal
attorney as soon as possible to discuss what
happened while it is all fresh in your memory and
for you to learn your legal rights and options as
soon as possible.
